1. Scope
These Terms of Service (ToS) govern the use of the “Volltreffer” platform (website and mobile app).
By using Volltreffer, you agree to these Terms of Service.
2. Service Description
Volltreffer provides a platform that allows users to create and participate in private prediction groups.
The use of the platform is completely free of charge.
There is no entitlement to specific features or their permanent availability.
3. Availability
Continuous availability of the platform cannot be technically guaranteed.
Especially during peak times (e.g., shortly before a match starts or immediately after it ends), delays or limited accessibility may occur.
Volltreffer reserves the right to temporarily restrict or suspend the platform for maintenance, security, or capacity reasons.
4. User Account and Use
- Use of the platform requires a user account (e.g., via Apple or Google Sign-In).
- Users are responsible for all activity conducted through their account.
- The platform may only be used in accordance with applicable laws and these Terms.
- Access credentials must not be shared with third parties and must be protected against unauthorized access.
5. Prediction Groups
5.1 General
All prediction groups on Volltreffer are private.
Creating and participating in prediction groups is free of charge. There is no limit on the number of participants.
5.2 Responsibility of Administrators
Each prediction group is managed by one or more administrators.
Volltreffer assumes no liability for content or rules within prediction groups.
Administrators are responsible for:
- content within the prediction group
- defined rules
- communication within the prediction group
5.3 Content within Prediction Groups
Administrators may define their own texts, rules, and content.
Administrators are solely responsible for such content.
It must be ensured that no applicable laws are violated.
5.4 Participation Fees and Prizes
Volltreffer is not a gambling or betting platform and does not organize or facilitate gambling.
Volltreffer is not involved in participation fees, stakes, or prize distributions and does not act as an organizer.
If participation fees are collected or prizes are awarded within a prediction group:
- the group must not be publicly accessible
- it must be limited to a closed group of users
6. Prohibited Use
In particular, it is prohibited to:
- publish content that violates applicable laws
- harass or harm other users
- use the platform abusively
- circumvent technical protection measures
7. Suspension and Restrictions
There is no entitlement to use the platform.
Volltreffer may suspend or restrict user accounts or prediction groups at any time, in particular if:
- these Terms are violated
- legal provisions are breached
- abuse or security-related incidents occur
8. Liability
8.1 Own Content
The content of the platform is created with the utmost care. No guarantee is given for the accuracy, completeness, or timeliness of the content.
To the extent permitted by law, Volltreffer's liability is limited to intent and gross negligence.
This does not apply to damages resulting from injury to life, body, or health or to claims under mandatory statutory provisions.
8.2 Third-Party Content
Volltreffer assumes no liability for content created by users within prediction groups.
8.3 Technical Availability
Volltreffer is not liable for damages caused by temporary unavailability or technical disruptions.
9. Advertising and External Content
Volltreffer reserves the right to display advertising or external links within the platform.
If a contract is concluded through such content, it is exclusively between the user and the respective provider.
Volltreffer is not a party to such agreements.
10. Privacy
The processing of personal data is carried out in accordance with the Privacy Policy.
The Privacy Policy forms an integral part of these Terms.
11. Changes to the Terms
Volltreffer reserves the right to amend these Terms at any time.
Changes will be announced within the platform. The current version shall apply.
Continued use of the platform after changes take effect constitutes acceptance, to the extent permitted by law.
12. Applicable Law
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
13. Final Provisions
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
